What is a divorce?

A divorce is a type of complaint that should include at least one of the following:
  • Your partner was already married at the time of your marriage.
  • Your partner has been absent for more than one year.
  • Your partner has committed adultery.
  • Your partner is abusive.
  • Your partner is neglecting their responsibilities.
  • Your partner has a substance abuse problem.
  • Your partner is incarcerated.
  • You and your partner have not lived in the same household for more than a year.
  • You & your partner are not compatible.

What is a no-fault divorce?

A no-fault divorce is when both parties agree that they no longer want to be married. A traditional divorce will typically cost more than a no-fault divorce as it takes time and money to prove fault.

What is an uncontested divorce?

An uncontested divorce is when your partner neither agrees or disagrees to any allegations, they just agree on the divorce. Typically this includes the settlement of all property, financials, child support, etc.

What is a dissolution?

A dissolution is when both partners agree on every aspect from the beginning to the final hearing. This would include financial division, property agreements, child support, alimony payments (if any), etc.

A dissolution is a faster way to obtain a divorce and the most cost-effective. This option is usually less painful for both parties as this can be a very emotional situation.

Each partner will need to obtain their own divorce attorney.

Do I need an attorney for a dissolution?

Although it is possible to file for a dissolution without hiring a divorce attorney, the process can become very drawn out. It becomes difficult to navigate this process alone. There is paperwork that needs to be filled out by both parties, some of which has to be filed in court.

Before you attempt to file for a dissolution on your own, be sure to set up your free consultation.

It is also recommended that you stop by your local county clerks office and obtain all the necessary paperwork needed for a dissolution. This will assist in giving you a better idea of the details involved in doing so.
